Terms and Conditions of Service

1. Acceptance of Terms
Welcome to Fresh Home Colors, a brand operated by Good Construction Team LLC, legally registered in the state of Maryland, United States. By using our website, requesting a quote, contacting us by any means, or hiring our services, you agree to all the terms set forth in this document. This agreement is legally binding and governs every interaction between you (as a client or visitor) and our company. If you do not agree with any portion of these terms, you are kindly asked not to use our services or our website. Acceptance of these terms can occur either explicitly or implicitly by continuing to browse the site, submit forms, communicate with us, or hire our services.
2. Services Provided
Fresh Home Colors offers professional painting services for residential and commercial properties. This includes interior and exterior painting, cabinet refinishing, deck and fence painting, surface restoration, and custom finishes. Color consulting services may also be provided when requested. We reserve the right to modify, expand, reduce, or discontinue any of our services at any time and without prior notice, depending on availability, location, staffing, season, or other logistical reasons.
3. Quotes and Job Confirmation
All price estimates provided through our website, in-person consultations, or by digital communication are non-binding until confirmed in writing. We make every effort to deliver accurate and honest quotes, but pricing may change based on actual site conditions, customer modifications, last-minute additions, or materials required. Estimates are valid for 15 calendar days unless otherwise stated. Once a quote is accepted, we issue a service confirmation to secure the schedule and prepare the materials.
4. Payments and Billing
Fresh Home Colors accepts payments via credit card, debit card, bank transfer, PayPal, Stripe, checks, and occasionally cash if permitted. In many cases, a deposit is required to reserve a service date. This deposit is non-refundable once materials have been purchased or labor has begun. The remaining balance is due at the time of project completion unless otherwise agreed in writing. Clients are expected to honor all payment commitments on time. Delays in payment may result in suspension of services and additional fees, including late charges.
5. Cancellations and Rescheduling
If you wish to cancel a service that has already been scheduled, you must notify us at least 72 hours in advance in writing. Cancellations made after that period may be subject to fees covering materials purchased and hours reserved or worked. If a project is canceled after work has begun, you are responsible for compensating the time, materials, and effort already invested. We reserve the right to reschedule or cancel a job due to emergencies, weather conditions, equipment failures, material shortages, or situations that would compromise service quality or safety.
6. Client Responsibilities
As a client, you are responsible for ensuring that the workspace is clean, safe, and accessible on the scheduled service date. You must provide access to electricity and running water if required. You are also expected to move fragile or valuable items out of the work area before our arrival. Fresh Home Colors is not liable for damage to items that were not properly protected or removed. You accept full responsibility for any pets, children, or guests on the property during service hours. If unsafe or obstructed conditions are encountered, we may postpone the work or charge additional fees for delays.
7. Site Access and Job Conditions
You agree to provide Fresh Home Colors and its crew with full and reasonable access to all necessary parts of the property during service hours. This includes interior and exterior access as needed. Temporary use of ladders, scaffolding, and equipment may be required. You also authorize us to take before-and-after photographs of the project for documentation and promotional use, provided we do not share identifying information, faces, or exact addresses without your written permission. If access is denied or the space is deemed unsafe, we reserve the right to reschedule and adjust pricing if applicable.
8. Colors and Final Results
We make every reasonable effort to match paint colors and finishes approved by the client. However, variations may occur due to differences in lighting, wall texture, previous coatings, and material absorption. We strongly recommend testing colors before proceeding with large-scale applications. Once a client approves a color and it has been applied, dissatisfaction with the shade does not constitute a reason for rework at our expense. Changes to color after application may incur additional charges.
9. Liability and Warranty
We take pride in our work and strive to provide high-quality, professional results. Limited warranties may be offered in writing depending on the type and scope of the project. You understand that environmental factors like humidity, water damage, sun exposure, improper maintenance, third-party interventions, or the use of harsh cleaning products may impact the results or void any warranty. In all cases, our liability is strictly limited to the amount paid for the service in question. We are not responsible for consequential, indirect, or business losses.
10. Digital Security and Online Risk
Fresh Home Colors uses secure technology to operate our website and manage online payments. Our payment providers comply with industry-standard security protocols (e.g., PCI-DSS). However, you understand that no digital system is 100% secure. Despite our best efforts, risks such as data breaches, service interruptions, or unauthorized access are always possible. By using our website, contact forms, or online checkout, you acknowledge these inherent risks and accept that we cannot offer absolute guarantees. You are responsible for your own security measures and for reporting any suspected compromise of your data.
11. Changes to Terms
We reserve the right to update or revise these Terms and Conditions at any time. All changes will be posted on our website with an updated “Effective Date” at the top. It is your responsibility to check for changes. By continuing to use our website or services after changes are published, you accept the updated terms automatically.
12. Jurisdiction, Disputes, and Conflict Resolution
This agreement and any commercial, legal, or contractual relationship between you and Fresh Home Colors, operated by Good Construction Team LLC, shall be governed by the laws of the State of Maryland, United States, without reference to its conflict of law principles. This includes, but is not limited to, interpretation, enforcement, claims, disputes, damages, missed payments, and misunderstandings arising from the services provided or your use of our website and platform.
Should any conflict or dispute arise, you agree to first contact us in writing and attempt a resolution through direct communication and good faith negotiation. Written communication must include the issue, relevant dates, and the desired resolution. We will review and respond within a reasonable timeframe. If no resolution is reached, the matter will be considered a formal dispute.
Both parties agree to submit any unresolved dispute to mediation or arbitration, preferably through a recognized entity such as the American Arbitration Association. Arbitration will take place in English and in Prince George’s County, Maryland, or the nearest available legal location within the state.
If arbitration is not pursued or is unsuccessful, you agree that all legal actions shall be filed exclusively in the state or federal courts of Prince George’s County, Maryland. Any other venue shall be considered invalid and without jurisdiction.
Legal claims must be submitted within one (1) year from the date the issue arose. Claims filed after that time will be legally dismissed. Both parties waive the right to a jury trial unless required by applicable law. The decision of the arbitrator or court shall be final unless an appeal is permitted by law.
You agree that any legal claim must be filed individually. No collective, group, or class actions may be initiated without the express written agreement of both parties. This includes representative lawsuits or consolidated claims.
